We may state with profit that principles of natural justice should neither be treated with absolute rigidity nor should they be imprisoned in a straight-jacket.

It has been held in Ajit Kumar Nagar versus general manager (PJ), Indian Oil Corporation Limited, Haldia and others, (2005) 7 SCC 764, that the maxim audi alteram partem cannot be invoked if the import of such maxim would have the effect of paralyzing the administrative process or where the need for promptitude or the urgency so demands. It has been stated therein that the approach of the Court in dealing with such cases should be pragmatic rather than pedantic, realistic rather than doctrinaire, functional rather than formal, and practical rather than precedential.

इस बात में भलाई है समझकर हम कह सकते है कि नैसर्गिक न्याय के सिद्धांतों को न तो पूर्ण कठोरता से लेना चाहिए और न ही उसमें संकीर्णता होना चाहिए। अजीत कुमार नागर बनाम महाप्रबंधक (पीजे), इंडियन ऑयल कॉर्पोरेशन लिमिटेड, हल्दिया और अन्य, (2005) 7 एससीसी 764 में यह माना गया है कि कहावत “दूसरे पक्ष को भी सुनें” (ऑडी अल्टरम पार्टेम) को प्रयोग में नहीं लाया जा सकता है क्योंकि यदि इस तरह की कहावत को लागू किया जाएगा तब जहाँ तत्परता और तात्कालिकता की आवश्यकता होगी वहाँ यह (कहावत) प्रशासनिक प्रक्रिया को पंगु बना देगी। इसमें यह भी कहा गया है कि ऐसे मामलों के निपटान के लिए न्यायालय का दृष्टिकोण व्यावहारिक होना चाहिए न कि दिखावापूर्ण, व्यवहारिक होना चाहिए, न कि सैद्धांतिक, क्रियात्मक होना चाहिए न कि औपचारिक, और इसे यथार्थपरक होना चाहिए न कि पूर्व निर्णित।
