In the present case, the
petitioner contends that the impugned order dated 15th March 2023, passed by
the District Magistrate, is arbitrary, illegal, and violative of the principles
of natural justice. It is submitted that no proper opportunity of hearing was
afforded to the petitioner before passing the said order, which resulted in
serious civil consequences affecting his livelihood. The petitioner further
submits that the authority failed to consider the material evidence placed on
record and proceeded on mere conjectures and surmises.
The respondent, on the
other hand, has vehemently opposed the petition, contending that the order in
question was passed after due consideration of the facts and circumstances of
the case, and that the petitioner was duly served with a notice but failed to
appear despite repeated opportunities. It is further stated that the petitioner
has not come to the Court with clean hands and has suppressed material facts.
Having heard both parties
and perused the record, this Court is of the opinion that the impugned order
cannot be sustained in law. The authority concerned appears to have acted in
haste and without recording proper reasons. The principle of audi alteram partemтАФthat
no person shall be condemned unheardтАФstands violated in the instant matter.
Therefore, in the interest of justice, equity, and fair play, the impugned
order is set aside. The matter is remanded back to the District Magistrate for
reconsideration in accordance with law after affording due opportunity of
hearing to the petitioner.
